Once the consultant has granted preliminary approval, the purchaser / agent shall prepare a formal submission for the consultants review and approval. This submission must contain the following:
- Site Plan
- Floor Plans
- Exterior Elevations
- Colour and Materials Sample Sheet
- Landscape Site Plan
The consultant shall, within five (5) working days of receipt of the formal submission, approve or deny the submission. The consultant may, before making a final decision, communicate any changes desired with the purchaser / agent.
It is hereby expressly declared that the consultant may arbitrarily withhold approval in the event that said plans and specifications are not drawn and states in strict accordance with the mandatory development controls.
The refusal or failure of the consultant acting in accordance with the terms of this manual shall not be actionable by any person under and circumstance, it being the sole discretion of the consultant to grant or withhold said approval subject only to the provisions herein stated.
The Builder may appeal a decision of the consultant to the developer, whose decision shall be final.
Upon the approval of a submission, the consultant will issue a letter of approval to the purchaser / agent. A building permit may now be applied for.
Two (2) inspections will be made by the consultant throughout the construction process. Requests for inspections are to be made in writing to the consultant upon completion of the dwelling and landscape construction.
Upon completion of the dwelling, including all exterior finishes. The dwelling must match the architectural form, character and exterior finishes of the approved plans.
Upon completion of the front yard landscaping. The landscaping must match the approved plans.
Failure to comply with the plans as submitted and approved will result in the loss of the compliance deposit, without prejudice to any other remedies which may be available to the Developer.
